TERMS OF SERVICE - BuddyTrading Crypto Trading Strategy Marketplace

This Agreement outlines the terms of use for the services provided by BuddyTrading, operated by Buddy Planet Inc., doing business as BuddyTrading.com. By using the services of the BuddyTrading.com Site, you fully accept this Agreement. If you disagree with any part of the Agreement, you should not proceed with using our services.

By accessing this Site and registering to use our Services, you agree to comply with the following terms and conditions ("Terms of Service"). Please read these Terms of Service carefully before using the website ("Site") or any services offered by this Site.

"Services" refer to the subscription for utilizing the Software accessible through our Website and/or Applications. This Software allows you to manage your cryptocurrency holdings across various Exchange Accounts, including but not limited to tools for cryptocurrency price and trading analytics, manual or automatic cryptocurrency trading order execution, and displaying of a cryptocurrency portfolio held with supported crypto exchanges, and other services provided by us to you via the Website and/or Applications under the terms of this Agreement.

2. Usage Terms

"BuddyTrading" refers to Buddy Planet Inc., including without limitation its owners, directors, investors, employees, or other related parties. BuddyTrading is a company with limited liability, incorporated under the laws of the United States of America. Depending on the context, "BuddyTrading" may also refer to the Services, products, Site, content, or other materials (collectively, "Materials") provided by BuddyTrading.

Depending on your country of residence, you may not be able to use all the functions of the Site. It is your responsibility to comply with the laws and regulations of your country of residence and/or the country from which you access this Site and Services. As long as you agree to and comply with these Terms of Service, BuddyTrading grants you a personal, non-exclusive, non-transferable, non-sublicensable, and limited right to enter and use the Site and Services.

BUDDYTRADING PROVIDES THE SERVICE. BUDDYTRADING DOES NOT PROVIDE FINANCIAL, INVESTMENT, LEGAL, TAX, OR ANY OTHER PROFESSIONAL ADVICE. BUDDYTRADING IS NOT A BROKER, FINANCIAL ADVISOR, INVESTMENT ADVISOR, PORTFOLIO MANAGER, OR TAX ADVISOR. YOU ACKNOWLEDGE AND AGREE THAT BUDDYTRADING IS NOT RESPONSIBLE FOR YOUR USE OF ANY INFORMATION OBTAINED ON THE SITE.

THE INFORMATION ON THIS SITE DOES NOT CONSTITUTE FINANCIAL ADVICE OR A SOLICITATION TO BUY OR SELL SECURITIES OF ANY TYPE. BUDDYTRADING WILL NOT ACCEPT LIABILITY FOR ANY LOSS OR DAMAGE, INCLUDING WITHOUT LIMITATION ANY LOSS OF PROFIT, ARISING DIRECTLY OR INDIRECTLY FROM THE USE OF OR RELIANCE ON SUCH INFORMATION.

TRADING CRYPTOCURRENCIES CARRIES A HIGH LEVEL OF RISK AND MAY NOT BE SUITABLE FOR EVERYONE. BEFORE ENGAGING IN CRYPTOCURRENCY TRADING, YOU SHOULD CONSIDER YOUR PERSONAL OBJECTIVES, EXPERIENCE, AND RISK APPETITE. YOU MAY SUSTAIN A LOSS OF SOME OR ALL OF YOUR INITIAL INVESTMENT AND THEREFORE SHOULD NOT INVEST FUNDS YOU CANNOT AFFORD TO LOSE. YOU SHOULD BE AWARE OF ALL RISKS ASSOCIATED WITH CRYPTOCURRENCY TRADING AND SEEK ADVICE FROM AN INDEPENDENT FINANCIAL ADVISOR IF YOU HAVE ANY DOUBTS.

YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. YOU ACKNOWLEDGE THAT YOU MAY LOSE SOME OR ALL OF YOUR FUNDS AND THE FUNDS OF YOUR CLIENTS, IF APPLICABLE.

BUDDYTRADING IS NOT RESPONSIBLE FOR OTHER RISKS THAT BUDDYTRADING CANNOT ANTICIPATE. SUCH RISKS MAY MATERIALIZE AS UNANTICIPATED VARIATIONS OR COMBINATIONS OF THE RISKS DISCUSSED HEREIN.

7. Account Registration

To use certain features on the Site, you must register for an Account and complete a profile. An "Account Holder" can be any natural person who enters into an agreement with BuddyTrading under these Terms of Service. The Terms of Service and related stipulations govern all rights and obligations arising from the use of this Site and Services. Each person wishing to register as an Account Holder is advised to read and understand these Terms of Service before final acceptance. These Terms of Service apply as long as the Account is accessible through the BuddyTrading platform.

By creating an Account to use the BuddyTrading Services, Account Holders represent and warrant:

• They have accepted these Terms of Service.
• They are at least eighteen (18) years of age.
• They have the capacity to accept these Terms of Service and enter into a relationship with BuddyTrading.

You are solely responsible for ensuring that using the Service in your jurisdiction of residence is permitted by law or regulation. If not permitted by law, we prohibit all access to and use of the Site.

During registration, you will need to provide certain information, such as your email address and a password. For more information on data collection, please see our Privacy Policy. You agree to provide accurate, current, and complete information about yourself and promptly update all information to ensure accuracy and completeness. You may update or change your Account settings at any time. Unauthorized persons are not permitted access to your Account.

8. Account Confidentiality

Any username, password, or other information chosen by you or provided as part of our security procedures must be kept confidential, and you must not disclose it to any other person or entity. Exercise caution when accessing your account from a public or shared computer to prevent others from viewing or recording your password or other personal information. Your account is personal, and you agree not to provide any other person with access using your username, password, or other security information. Notify us immediately of any unauthorized access or use of your username or password or any other security breach. Ensure you logout from your Account at the end of each session. You are responsible for any password misuse or unauthorized access.

You acknowledge that we shall not be responsible for any damage or loss caused by unauthorized use of your Account due to your failure to maintain password confidentiality.

You have the right to close your Account at any time once all associated obligations have been fulfilled.

9. Account Holder Representations and Warranties

By registering an Account, Account Holders expressly represent and warrant that they:

• Have accepted these Terms of Service.
• Follow the laws of their country of residence and the country from which they access this Site and Services.
• Are responsible for ensuring their use of the Service complies with local, provincial, and federal laws and regulations.
• Are at least 18 years old, legally capable of accepting these Terms of Service, and participating in cryptocurrency transactions.
• Will provide BuddyTrading with accurate, current, and complete information and update it as needed.
• Are responsible for maintaining the confidentiality of their Account information and all activities under their Account.
• Are using funds that belong to them and are derived from legal sources.
• Are not using funds originating from illegal activities.
• Are not a politically exposed person and have no relationship with one. If untrue, contact BuddyTrading for further instructions.
• Do not violate third-party rights or applicable laws with their transactions.
• Will only withdraw cryptocurrencies to their proprietary wallets. BuddyTrading has no liability for verifying wallet ownership or consequences of erroneous or fraudulent withdrawals.
• Will not use the platform to create false profiles, access unauthorized content, interfere with the platform, engage in unlawful activities, or misuse the platform's services and intellectual property.

10. Client Data

All Client data is and will remain the property of the Client. Without Client approval, Client data shall not be used by BuddyTrading other than to provide Services, disclosed, sold, assigned, leased, or otherwise provided to third parties by BuddyTrading, or commercially exploited. BuddyTrading assigns all rights to Client data to the Client without further consideration.

11. Aggregated Data

Client grants BuddyTrading a non-exclusive, transferable, assignable, irrevocable, royalty-free, worldwide, perpetual license to create and use aggregated, anonymized, and de-identified data for any purpose, including enhancing the platform, research, analytics, and marketing. BuddyTrading will ensure that this aggregated data does not identify the Client.

12. Termination

BuddyTrading may terminate your use of the Site or Services at its discretion without liability, immediately and without notice, if BuddyTrading believes you have breached the Terms of Service or violated applicable laws, engaged in fraudulent activity, or if your continued use of the Services is considered a security risk or legal liability. BuddyTrading may suspend or terminate access to your Account and delete related information and files. In case of suspension or termination, the Client must immediately cease using the Site and Services and notify BuddyTrading of any losses. In some cases, refund requests may be honored at BuddyTrading's discretion, depending on Service usage. This Agreement survives termination and continues to bind both parties.

13. Amendments

BuddyTrading reserves the right to modify or amend these Terms of Service at any time. If changes are made, BuddyTrading will notify users via the Site. Continued use of Services after notification of changes constitutes acceptance of the revised Terms. Users should periodically review the Terms for updates.

14. Privacy Policy

15. Governing Law

These Terms of Service and any disputes arising out of or related to them are governed by and construed in accordance with the laws of the United States of America. You agree to submit to the exclusive jurisdiction of the courts located in the United States of America to resolve any disputes.
